The screenwriter of "The Passion of the Christ" fired back in court at actor-director Mel Gibson, who is seeking to dismiss portions of the man's lawsuit alleging that Gibson misled him into accepting a small payment for penning the script.
"Mel Gibson, under the guise of spiritual commitment, materially misrepresented the budget of, his take from and the company that would produce `The Passion,"' William Zeltonoga, the lawyer for screenwriter Benedict Fitzgerald, wrote in court papers filed Monday.
The papers further maintain that "Gibson cohorts joined in the scheme of false representations and other overt acts in a web of conspiracy including an elaborate coverup."
Fitzgerald alleges in a Los Angeles Superior Court lawsuit filed Feb. 11 that he was refused millions of dollars in extra money when the film became a blockbuster.
The lawsuit also names the 52-year-old Gibson's Icon Productions LLC as a defendant as well as Icon executive Vicki Christianson. The suit maintains Christianson provided false information concerning the money he is entitled to receive from the film.
In court papers filed in March, Gibson asked that six of Fitzgerald's nine causes of action be dismissed, most notably fraud, which if proven would allow the plaintiff to seek punitive damages. A hearing is scheduled for June 20 before Judge Gregory W. Alarcon.
Fitzgerald claims that when he was asked to write a script about the crucifixion of Jesus Christ, Gibson told him the movie would cost between $4 million to $7 million. Fitzgerald also alleged Gibson promised he would not get any money from the film and any profit would be distributed to people who worked on it.
Gibson stated he did not want "money on the back of what he considered a personal gift to his (Roman Catholic) faith," the lawsuit states.
Fitzgerald, who shared screenwriting credits with Gibson, claimed he agreed to "a salary substantially less than what he would have taken had he known the true budget for the film," which the lawsuit claimed had an estimated budget of $25 million to $50 million.
The 2004 movie went on to gross several hundred million dollars. Fitzgerald maintains that he was entitled to 5 percent "contingent participation" based on the film's revenues and that an audit showed the revenue participation statements given him were off by more than $30 million.
But in support of the argument in favor of dismissal of the fraud claim, Gibson's court papers state that Fitzgerald had to have known of the actual budget for the film because of the extensive publicity surrounding its release.
"Given the tremendous marketing campaign behind `The Passion,' the unprecedented publicity generated before, during and after its release, and plaintiff's unbridled enthusiasm for the project, there is little doubt (he) was on notice as to the actual budget and production," Gibson's court papers state.
"Moreover, it is objectively unreasonable for (Fitzgerald) to contend that he had no reason to suspect either the size of (the movie's) budget -- or the fact that Mel Gibson profited from the film -- seven months after he alleges that he received his first participation statement on June 28, 2004," Gibson's court papers further state.
Fitzgerald also waited too long to file the lawsuit and he has not shown any justification for the delay, according to Gibson's court papers. Fitzgerald's recent court papers reject that argument.

Ed Limato will be awarded the Ischia Art Legend career achievement prize at the sixth Global Film and Music Fest in July.
Limato, 71, recently landed at WMA after a long tenure at ICM. His stable of clients includes Richard Gere, Mel Gibson, Steve Martin and Denzel Washington.
Set to join Limato at the star-studded July 13-20 fest off the coast of Naples are actors Raul Bova, Claire Danes and Vanessa Redgrave, directors Paul Haggis and Lina Wertmueller, plus Monty Python's Terry Gilliam.

A long-waited sequel co-authored by famed war reporter Joseph L. Galloway will be arriving in August and has already picked up rave reviews in Publishers Weekly and Kirkus Reviews.
A sequel to "We Were Soldiers Once...and Young," and again written with Harold G. Moore, it is titled, "We Are Soldiers Still: A Journey Back to the Battlefields of Vietnam," and will be published by Harper. The first book was made into a film starring Mel Gibson, with Barry Pepper portraying Galloway, who won a Bronze Star for valor in Vietnam.
Galloway retired from McClatchy Newspapers last year after covering at least seven wars, but continues to write a military column.
The Publishers Weekly "starred" review follows.
It would be a monumental task for Moore and Galloway to top their classic 1992 memoir, "We Were Soldiers Once... and Young." But they come close in this sterling sequel, which tells the backstory of two of the Vietnam War's bloodiest battles (in which Moore participated as a lieutenant colonel), their first book and a 1993 ABC-TV documentary that brought them back to the battlefield.
Moore's strong first-person voice reviews the basics of the November 1965 battles, part of the 34-day Battle of the Ia Drang Valley. Among other things, Moore and Galloway (who covered the battle for UPI) offer portraits of two former enemy commanders, generals Nguyen Huu An and Chu Huy Man, whom the authors met-and bonded with-nearly three decades after the battle.
This book proves again that Moore is an exceptionally thoughtful, compassionate and courageous leader (he was one of a handful of army officers who studied the history of the Vietnam wars before he arrived) and a strong voice for reconciliation and for honoring the men with whom he served.
